Teaching in the Age of DPDPA: When Child Safety Becomes EdTech’s Competitive Advantage

The Digital Personal Data Protection Act, 2023 (DPDPA) marks a profound shift in India’s data protection landscape; however, its specific effects on the educational technology sector are not yet fully understood. Although the wider industry has been navigating consent protocols and data fiduciary responsibilities, the regulatory framework’s detailed treatment of children’s personal data, alongside the specific exemptions for educational use, necessitates a level of intellectual rigour and operational expertise that many EdTech platforms currently lack. This analysis explores the key provisions concerning minors’ data protection and the educational exceptions outlined in the DPDPA, offering a clear understanding of compliance strategies while also considering the inherent conflict between educational advancement and the protection of children. 

The Regulatory Imperative: Why Minors Require Categorical Protection 

Section 9 of the DPDPA defines a key principle: children, defined as those under 18, are a legally protected group. This means they require different data governance rules than adults. This broad definition, which is intentionally wider than similar laws in the United States (where COPPA applies to children under 13) and the European Union (where the GDPR has different rules), shows India’s intentional policy choice to provide extra protection throughout the entire developmental period, until legal adulthood. The rationale for this definition is well-supported. Developmental psychology and neuroscience both suggest that the ability to make decisions, especially those involving privacy, is still developing during adolescence. This is because the prefrontal cortex, which is crucial for these decisions, continues to mature into the late twenties. Therefore, the DPDPA’s legal interpretation aligns with current scientific understanding, rather than being based on the interests of businesses. 

Mandatory Parental Consent: Architecture and Verification Mechanisms 

The Data Protection and Digital Personal Data Protection Act (DPDPA) establish parental consent as the legal cornerstone for protecting minors’ data, necessitating verification before any processing of children’s personal information. This requirement, outlined in Section 9(1), is a universal condition for all Data Fiduciaries, irrespective of their sector or the extent of their processing activities, with exceptions only in specific circumstances.  

The Data Protection and Digital Personal Data Protection Rules (DPDP Rules) of 2025, which became effective in November 2025, detail the procedural framework. Rule 10 mandates that Data Fiduciaries implement “appropriate technical and organisational measures” to authenticate parental identity and validate parental authority. The Rules specify two distinct verification methods: initially, utilising “reliable details” already held by the Data Fiduciary from prior verifications; and secondly, accepting identity information verified through government-sanctioned systems, particularly the Digital Locker service. This dual strategy, despite its apparent practicality, engenders considerable compliance intricacies. The dependence on pre-existing user data presents a fundamental data minimisation conflict; specifically, the verification of parental consent could require the retention and reprocessing of parental identity documents, extending beyond their initial purpose. The Digital Locker mechanism, which is contingent upon the technological sophistication of the platform and parental comfort with governmental digital systems, is predicated on assumptions that are potentially problematic within certain segments of the Indian market, where digital literacy levels are inconsistent.

Prohibitions and Protective Boundaries: Section 9(3) Restrictions 

Section 9(3) goes further beyond just requiring consent; it also sets out specific rules about how children’s personal data can be used. The law clearly forbids three main things: monitoring behaviour, tracking behaviour, and targeted advertising aimed at children. Importantly, these restrictions apply regardless of whether consent is given. Even if parents agree, these types of data processing are still not allowed, except in cases where the law makes an exception. 

This prohibition’s categorical character diverges from traditional consent-based models, where parental approval ostensibly allows any processing considered beneficial for the child. The DPDPA, however, delineates non-negotiable limits concerning specific processing methods, mirroring a policy decision that certain surveillance and behavioural manipulation techniques are inherently detrimental to minors and, therefore, cannot be justified through consent. This approach mirrors the evolution of international norms, as demonstrated by the European Union’s analogous fundamental ban on profiling practices involving children. 

Educational Institution Exemptions: Scope and Substantive Limitations 

At the foundation of the regulatory structure that allows EdTech companies to function while safeguarding children is Schedule 4 of the DPDP Rules 2025. This schedule outlines exclusions, both based on the entity involved and the specific purpose, from the usual rules that regulate the handling of children’s data. Educational institutions, which are defined as “institutions of learning that impart education, including vocational learning,” are eligible for exemptions from the requirements of verifiable parental consent and restrictions on tracking and behavioural monitoring. This is contingent upon the processing being limited to two specific purposes: facilitating educational activities and safeguarding children. This definition, however, presents an interpretive issue: whether it applies solely to conventional, formal educational institutions or also includes private educational service providers, such as digital-first EdTech platforms.  

The most prevalent perspective within privacy law circles asserts that the exemption is limited in scope, extending primarily to conventional institutional entities rather than to commercially-driven EdTech companies that operate independently. For platforms that could reasonably be classified as educational institutions, these exemptions are restricted to data processing activities directly related to educational purposes and student safety. Consequently, these entities are prohibited from utilising children’s educational data for practices such as behavioural targeting, profiling, commercial analytics, marketing optimisation, or the monetisation of secondary data. The functional ramifications are substantial; the exemption facilitates the handling of educational data while simultaneously imposing constraints on the data-driven monetisation approaches commonly employed in the EdTech industry. Schedule 4, Part B delineates specific processing purposes that are exempted, even for Data Fiduciaries not directly associated with educational establishments, including processing for government-sponsored educational services, real-time location tracking to safeguard children, and processing intended to limit access to inappropriate content. These provisions directly underpin protective content filtering and age-appropriate curation systems, all while remaining compliant with child safety mandates. 

The Legitimate Use Framework: Educational Processing Without Consent 

In addition to the exclusions for organisations and objectives, the DPDPA introduces a concurrent structure that facilitates specific educational processing without necessitating explicit consent, provided it adheres to the “legitimate uses” stated in Section 7Section 7(a) is particularly pertinent to educational contexts, allowing processing “for the specified purpose for which the Data Principal has voluntarily provided her personal data to the Data Fiduciary.” Nevertheless, the legitimate uses specified in Section 7 are subject to the principle of purpose limitation, as stipulated in Section 6

Data collected for educational objectives is not legally permissible for behavioural analytics, marketing optimisation, or commercial analytics unless fresh consent is acquired, an Schedule 4 exemption is applicable, or it is established that the secondary purpose is congruent with the initial educational aim. Unlike the GDPR’s proportionality framework, the DPDPA lacks a “compatible purposes” doctrine; therefore, Indian EdTech platforms face more rigorous constraints on data reuse than those operating within Europe. 

Behavioral Monitoring and Personalized Learning: The Central Tension 

The paramount rule that the DPDPA places on EdTech innovation is that companies cannot track their users’ behaviour. This is especially true for platforms that use Personalised Adaptive Learning (PAL) technologiesPAL systems work by looking at detailed information on strokes, time-on-task, quiz responses, and learning speed. They then use algorithms to adapt the order of lessons for each student. The absolute ban on behavioural tracking raises a clear question: how can platforms use advanced tailored content without looking at behavioural data? The answer comes in the legal difference between watching someone’s behaviour and continuous, systematic surveillance for behavioural control or commercial exploitation, as opposed to behavioural processing for educational improvement. The first still can’t be done, but the second is still allowed as long as it is only for educational reasons and isn’t a form of constant surveillance. 

The DPDPA, on the other hand, does not include a clear test to tell the difference between these groups, which makes it hard for EdTech companies to know how to follow the rules. The Data Protection Board has not yet given any advice to any specific industry on PAL technologies or behavioural processing in school when it comes to interpreting their rules, even though they have the power to do so. Without this kind of help, platforms face a tough choice: either use very strict private rules that hurt the ability to teach or risk getting in trouble for supposedly “monitoring” behavioural” under rules that aren’t clearly defined. 

Parental Consent Verification: Operational Challenges and Solutions 

While DPDP Rules 2025 lay down the legal framework for verifying parental permission, putting these rules into practice reveals a lot of problems. The way of verifying identity or identification through Digital Locker or data from previous registrations assumes that the technology used is equally available to all people in India, which is not the case. A big problem is something called “identity verification fatigue.” When kids want to use more than one EdTech site, parents must verify their identity and give permission each time. This process must be done repeatedly, which is not only annoying but also creates a serious risk that people won’t follow the rules. This is because parents may skip the consent process, which can result in non-compliance or failure to acquire users. The Common Consent Mechanism is a new solution framework based on how consent governance structures work on technology platforms like Google Play. It suggests that trusted third parties should verify parents and then use that verification status across multiple child-directed apps. While India’s rules don’t yet include it, acceptance by the Data Protection Board could greatly lower the need to comply with rules and at the same time make consent more useful. 

Segmented Compliance: Entity-Specific Implementation Pathways 

Compliance responsibilities vary across different types of EdTech businesses. When EdTech platforms work directly with students or parents, they act as independent Data Fiduciaries and can’t count on exemptions for educational institutions. These organisations must get proof of parental consent before handling any minor’s personal data. They also need to set up Digital Locker connections or other ways for users to verify their identity. When schools hire EdTech service providers, those companies work as Data Processors for the schools. In this setup, as long as the school gets the right permission from parents for EdTech processing, the platform can rely on the school’s consent. The school also doesn’t have to worry about legal issues when monitoring and tracking students, as long as it’s for safety and educational reasons. 

Data Retention and Erasure Obligations 

The DPDPA sets required deletion rules that are especially strong for data about children. Rule 8 says that Data Fiduciaries must delete the personal data of users who haven’t been active for three years, except for data that needs to be kept to follow the law. If parents take away consent, the information must be erased right away. Once the educational goals end, it is not okay to keep the information any longer unless the law says you must. 

Pathway Forward 

Privacy-by-design implementation should be done by EdTech platforms. They should separate the processing of kids’ data from adults’ and use different ways of getting permission and protection for each. As per Schedule 4, organisations should carefully compare all their data processing activities with allowed “educational purposes.” This will help them record which processing activities are still legal and which need to be removed or have the business model redesigned. Strong parental consent and identity verification systems must be put in place by platforms. Consent fatigue should be taken into account when thinking about interoperability standards. Groups that rely on behavioural monitoring should look into other ways of teaching, like learning outcome measurement based on performance instead of surveillance, clear parental oversight, or educational redesign that lowers algorithmic personalisation. 

Conclusion 

The DPDPA rules that protect kids’ personal data do not get in the way of new ways to teach but do get in the way of kids’ safety. As parents and regulators learn more about data protection, EdTech platforms that deliberately change their data architectures, consent mechanisms, and teaching methods to comply with DPDPA requirements will protect children’s data. This makes those platforms more competitive. The rules say that you can’t track, profile, or make money of children’s data through ads without the parent’s permission. Within these boundaries, the growth of smart and compatible teaching technology is possible. Privacy compliance as a design idea that is important for educational effectiveness and honesty in institutions will help platforms deal with these rules.
